أ- يُنشأ لدى وزارة الصناعة والتجارة والتموين حساب لتغطية النفقات الضرورية المتعلقة
بإجراءات الإعسار في حال عدم وجود أموال لدى المدين.
ب- يغطي الحساب النفقات القضائية وأتعاب وكيل الإعسار .
ج- تتكون المصادر المالية لهذا الحساب مما يلي:-
1 - مبلغ مخصص من الخزينة يحدد بقرار من مجلس الوزراء.
2 . - نسبة من رسوم تسجيل المدينين المنصوص عليهم في هذا القانون
3 . - نسبة من رسوم ترخيص وكلاء الإعسار
4 . - نسبة من أتعاب وكلاء الإعسار
( د- تحدد قيمة المساهمات المبينة في البنود 2 ) ( و 3 ) ( و 4 ) من الفقرة (ج) من هذه المادة وكيفية
الصرف من هذا الحساب ومراقبة الدفعات وآليات تحديد الحد الأدنى لأتعاب وكلاء الإعسار في
حالات الإعسار بدون أموال بشكل سنوي بمقتضى النظام الصادر لهذه الغاية.
