أ- يمنح الاعتراف بالإجراءات الأجنبية وكيل الإعسار الأجنبي الحق في اتخاذ أي إجراء لتقرير عدم
نفاذ التصرفات التي تضر بالدائنين.
ب- إذا كانت الإجراءات الأجنبية ثانوية فعلى المحكمة أن تبين في قرارها بأن الإجراءات تتعلق
بأموال يوجب هذا القانون إدارتها من وكيل إعسار أجنبي.
