Article text
أ- لا يجوز التنفيذ على أموال المدين بعد إشهار الإعسار وتوقف إجراءات التنفيذ التي بدأت قبل
إشهار الإعسار وعلى المحكوم له أن يسجل مطالبته من خلال إجراءات الإعسار ويلتزم وكيل
الإعسار بإدراج الدين تلقائيا في قائمة الدائنين دون أن يعد ذلك تنازلا عن حقه في استئناف قرار
الحكم وفقا لأحكام التشريعات النافذة.
ب- لا يجوز إلقاء الحجز على أي من أموال المدين أو حبسها لاستيفاء أي دين عليه مهما كان
أصله وطبيعته بما في ذلك الديون المستحقة للخزينة بعد إشهار الإعسار.
ج- على الرغم مما ورد في الفقرتين (أ) و(ب) من هذه المادة لأصحاب الحقوق المضمونة التنفيذ
على ضماناتهم التي لا يؤثر التنفيذ عليها في استمرار النشاط الاقتصادي للمدين على أن يتم
تسليم حصيلة التنفيذ الى وكيل الإعسار ليتم توزيعها وفقاً لأحكام هذا القانون .
د- يسري حظر التنفيذ والحجز المنصوص عليه في هذه المادة لمدة ستة أشهر من تاريخ إشهار
الإعسار أو الى حين الموافقة على خطة إعادة التنظيم أيهما أسبق.
