Article text
أ- لا يؤثر إشهار الإعسار على استمرار العقود الجاري تنفيذها ولغايات هذا القانون تعني عبارة
العقد الجاري تنفيذه بأنه العقد الذي لم يستكمل المدين ولا الطرف الآخر تنفيذه بتاريخ إشهار
الإعسار.
- ب 1 - لوكيل الإعسار أو للمدين بإشراف وكيل الإعسار حسب مقتضى الحــال ان يستمر في تنفيذ
العقد الجاري تنفيذه وأن يطالب الطرف الآخر بتنفيذ التزاماته بالكامل.
1 - للطرف الآخر أن يطلب من وكيل الإعسار أو من المدين بإشراف وكيل الإعسار أن يتخذ قرارا
يتعلق برغبته في الاستمرار في تنفيذ العقد خلال مدة خمسة أيام من تاريخ تبلغ الطلب وإلا
سقط الحق في ذلك .
ج- لوكيل الإعسار أو للمدين بإشراف وكيل الإعسار حسب مقتضى الحال أن يطلب إنهاء العقد
الجاري تنفيذه إذا كان ذلك يحقق مصلحة لإجراءات الإعسار وفي هذه الحالة يسقط التزام
الطرفين بتنفيذ باقي الالتزامات بموجبه و للطرف الآخر المطالبة بالضرر الناشئ عن ذلك وفق
شروط العقد وتعتبر المطالبة بالضرر دين إعسار غير مضمون.
