Article text
أ- لا تخضع ديون الدائنين في مواجهة إجراءات الإعسار للإجراءات المنصوص عليها في هذا
القانون وتعطى الأولوية المطلقة لسداد ديونهم من ذمة الإعسار عند استحقاقها ولا يقدم
عليها إلا الديون المضمونة في حدود حصيلة بيع الضمانة.
ب- تعتبر المطالبات التالية ديونا في مواجهة إجراءات الإعسار:-
نفقات إجراءات الإعسار، بما في ذلك الرسوم والمصاريف القضائية
وأتعاب وكيل الإعسار والنفقات التي وافقت عليها لجنة الدائنين
وأتعاب محامي ذمة الاعسار.
النفقات الناجمة عن تنفيذ واجبات وكيل الإعسار وفقا لأحكام هذا القانون.
نفقة الزوجة والأولاد والوالدين والأقارب المستحقة على المدين من الأشخاص الطبيعيين بعد
إشهار الإعسار.
التسهيلات المالية والتجارية الممنوحة للمدين بعد إشهار الإعسار بموافقة وكيل الإعسار بموجب
أحكام هذا القانون.
المبالغ المستحقة على المدين بموجب العقود الجاري تنفيذها والتي أبرمها أو وافق عليها
وكيل الإعسار بعد تاريخ إشهار الإعسار.
الالتزامات الأخرى التي تنشأ بعد إشهار الإعسار في سياق استمرار النشاط الاقتصادي والمنصوص
( عليها في الفقرتين )و( و)ز( من المادة 17 ) ( والمادة 19 ) من هذا القانون .
