Article text
أ- تحدد أسس تقدير أتعاب وكلاء الإعسار بموجب نظام يصدر لهذه الغاية على أن يؤخذ بالاعتبار
ما يلي حداً أدنى:-
1 - قيمة ذمة الإعسار.
2 - مدى صعوبة الحالة وتعقيدها، بما في ذلك استمرار النشاط الاقتصادي وعدد الدائنين وتعدد
. وحدات النشاط الاقتصادي وعدد العمال
3 - ربط استحقاق جزء من الأتعاب بتحقيق نتيجة.
. ب- يجب أن يتضمن النظام منح الدائنين الحق في الاشتراك في تحديد أتعاب وكيل الإعسار
ج- تحدد المحكمة أتعاب وكيل الإعسار عند تعيينه .
د- لوكيل الإعسار ولأي من دائني الإعسار الاعتراض على قرار المحكمة بتحديد أتعاب وكيل
الإعسار خلال مدة خمسة أيام من تاريخ صدوره وعلى المحكمة البت فيه خلال مدة خمسة أيام
من تاريخ تقديمه .
هـ- إذا لم تكف ذمة الإعسار لدفع أتعاب وكيل الإعسار فيتقاضى مبلغا مقطوعا وفقا لأحكام
( المادة 112 ) من هذا القانون.
