Article text
أ- على وكيل الإعسار أن يقدم تقريرا ماليا وإداريا بما استكمل من أعمال تنفيذا لمهامه في
نهاية المرحلة التمهيدية ضمن التقرير المعد منه وفقا لأحكام هذا القانون.
ب- يقدم وكيل الإعسار تقرير المحاسبة النهائي للجنة الدائنين والتي تقوم بدورها بإبداء
ملاحظاتها عليه خلال مدة عشرة أيام من تاريخ تسلمه .
ج- يودع تقرير المحاسبة النهائي مع ملاحظات لجنة الدائنين إن وجدت لدى المحكمة ويتم
تبليغه للمدين ودائنيه ويتم نشر واقعة الإيداع في سجل الإعسار.
د- للمدين ودائنيه الاعتراض على تقرير المحاسبة النهائي خلال مدة عشرة أيام من تاريخ إيداعه
لدى المحكمة وإذا لم يقدم أي اعتراض خلال المدة المذكورة تعتمده المحكمة دون حاجة لاتخاذ
أي إجراءات أخرى.
هـ- إذا تم الاعتراض على تقرير المحاسبة النهائي فتبلغ لائحة الاعتراض والبينات المعززة له
لوكيل الإعسار وعلى وكيل الإعسار أن يجيب خطيا على اللائحة خلال مدة عشرة أيام من تاريخ
تبلغه.
و- تعين المحكمة موعدا للنظر في الاعتراض لا يتجاوز مدة عشرة أيام من تاريخ تقديم جواب
وكيل الإعسار أو انتهاء المدة القانونية له، ويبلغ الموعد لوكيل الإعسار والخصم.
