Article text
أ- على وكيل الإعسار أن يقدم تقريراً متكاملاً للمحكمة حول خطة إعادة التنظيم خلال مدة
خمسة عشر يوما من تاريخ تبلغها على أن يتضمن التقرير رأيه حول مدى قابلية النشاط الاقتصادي
للاستمرار إذا تم تنفيذ الخطة وإمكانية تنفيذها بشكل فاعل.
ب- مع مراعاة أحكام الفقرة (أ) من هذه المادة، يجب أن يتضمن تقرير وكيل الإعسار ما يلي:-
1 - أن الخطة تتضمن المعلومات المنصوص عليها في هذا القانون و المعلومات اللازمة لتمكين
. المحكمة والدائنين من اتخاذ القرار المناسب بشأنها
2 - مدى معقولية الفرضيات التي بنيت عليها خطوات إعادة التنظيم وتوقعات التدفقات
. النقدية التي تضمنتها الخطة
3 - رأيه فيما إذا كان مبلغ الديون المتوقع استيفاؤه من الدائنين من خلال الخطة أكبر من المبلغ
. المتوقع استيفاؤه في حال تصفية أموال المدين
4 - رأيه فيما إذا كانت الخطة المقدمة تحسن إمكانية استيفاء الدائنين لديونهم.
5 - رأيه فيما إذا كان تنفيذ الخطة لن يؤدي لاستيفاء أي من الدائنين أو فئة منهم مبالغ تقل عن
. تلك التي سوف يستوفونها في حال تصفية أموال المدين
6 - رأيه فيما إذا كان يجوز الطعن بأي مبالغ مستحقة للأشخاص ذوي صلة بالمدين.
7 - أثر عدم قدرة المدين على متابعة أي إجراءات قضائية أو إنجاز أي عمل منصوص عليه في
