أ- لغايات التصويت على خطة إعادة التنظيم، يُقسم الدائنون إلى فئات مختلفة تبعا لمرتبة
( ديونهم وذلك وفقا لأحكام المادتين 38 ) ( و 40 ) من هذا القانون ويتم تشكيل فئات أخرى ضمن
الفئة ذاتها من الدائنين أصحاب الديون الممتازة.
ب- للجهة التي تعد خطة إعادة التنظيم أن تقترح تقسيم الدائنين لفئات ضمن الفئة الواحدة
لأسباب أخرى خلاف قيمة الدين خصوصا فيما يتعلق بالدائنين بديون غير مضمونة.
