أ- لا يحق للدائنين الأدنى في مرتبة الأولوية، والشركاء و المساهمين في المدين ومن في
حكمهم إذا كان شخصا اعتباريا التصويت باستثناء الشركاء الدائنين الذين لا يندرجون تحت
تعريف الشخص ذي الصلة بالمدين.
ب- إذا تضمنت خطة إعادة التنظيم خصما من ديون الدائنين أصحاب الديون الممتازة أو غير
المضمونة فتعتبر الديون الأدنى في مرتبة الأولوية مشطوبة أما إذا تضمنت الخطة تأجيل ديون
أصحاب الديون الممتازة أو غير المضمونة فيتم تسديد الديون الأدنى في مرتبة الأولوية بالطريقة
التي تضمنتها الخطة بعد سداد الديون الممتازة وغير المضمونة بالكامل.
