Article text
أ- يجوز الموافقة على خطة إعادة التنظيم ولو لم تحصل فئة من الدائنين على الأغلبية
المطلوبة خلال اجتماع الدائنين اذا تحققت الشروط التالية:-
أن لا يؤدي تنفيذ الخطة إلى وضع الدائنين من الفئة ذاتها
في مرتبة أدنى من مرتبتهم فيما لو تمت تصفية النشاط
الاقتصادي.
أن لا يلحق ضرر بأي من أعضاء أي فئة مقارنة مع اعضاء
الفئات الأخرى من المرتبة ذاتها.
أن لا يتقاضى أي دائن من ضمن أي فئة أخرى من الدائنين
مبلغاً أعلى من إجمالي ديون تلك الفئة.
ب- تقرر المحكمة اعتماد خطة إعادة التنظيم الواردة في الفقرة (أ) من هذه المادة بناء على
طلب وكيل الإعسار أو المدين وفي هذه الحالة على المحكمة عرضها على وكيل الإعسار .
