إذا لم تكن حصيلة التنفيذ كافية للوفاء بجميع الديون فتقسم بين الدائنين قسمة غرماء في
حال كون الديون في مرتبة
واحدة وإذا لم تكن الديون في مرتبة واحدة فتوزع حصيلة التنفيذ حسب الترتيب التالي :-
أ-النفقات والاجور وتقدم نفقة الزوجة ونفقة الصغار واجرة المسكن على غيرها من النفقات
والاجور ثم نفقة العلاج ثم نفقة الوالدين ثم نفقة التعليم ثم نفقة الأقارب ثم اجرة الرضاع ثم
اجرة الحضانة.
ب- بقية الديون الأخرى وتكون في مرتبة واحدة .
