يعاقب كل من يرتكب جرم التهرب من الضريبة بدفع تعويض مدني للدائرة لا يقل عن مثلي
مقدار الضريبة ولا
يزيد على ثلاثة أمثالها و بغرامة جزائية لا تقل عن مئتي دينار ولا تزيد على ألف دينار وفي حالة
التكرار للمرة
الثانية تضاعف الغرامة الجزائية المحكوم بها. وإذا تكرر ارتكاب الجرم بعد ذلك خلال سنة واحدة،
فللمحكمة أن
تحكم بالحد الأعلى للغرامة أو بالحبس لمدة لا تقل عن ثلاثة أشهر ولا تزيد على ستة أشهر أو
بكلتا العقوبتين.
