Article text
أ- تتولى النيابة العامة الضريبية تمثيل الدائرة في جميع القضايا التي تكون طرفاً فيها امام
المحكمة وفق الاختصاصات والصلاحيات المحددة لكل من اعضائها .
ب- تقام الدعاوى في الجرائم المنصوص عليها في هذا القانون بناءً على طلب المدير او رئيس
النيابة العامه.
- ج 1 - على الرغم مما ورد في أي قانون آخر، تعتبر خدمة كل من أشغل احدى وظائف النيابة العامة
الضريبية خدمة قضائية لغايات قانون
استقلال القضاء وقانون نقابة المحامين النظاميين شريطة ان لا تقل هذه الخدمة عن ثلاث
سنوات متتالية.
2 - تعتبر خدمة المدعي العام الذي مارس وظيفة النيابة العامة في القضايا المتعلقة بالضريبة
امام محكمة الجمارك البدائية ومحكمة الجمارك الاستئنافية
( ومحكمة التمييز من ضمن خدمة المدعي العام الضريبي لغايات البند 1 ) من هذه الفقرة .
