أ- يوقف صرف بدل التعطل عن العمل للمؤمن عليه إذا ثبت للمؤسسة انه عاد إلى عمل
يتقاضى عنه أجراً أو زاول
عملا تجاريا أو مهنيا لحسابه الخاص وتحدد الأنظمة الصادرة بمقتضى أحكام هذا القانون أي
حالات أخرى لإيقاف
صرف هذا البدل.
ب- إذا ثبت للمؤسسة أن المؤمن عليه تقاضى بدل التعطل عن العمل دون وجه حق فيتم
استرداد جميع المبالغ
المصروفة له مع الغرامة التي تحددها الأنظمة الصادرة بمقتضى أحكام هذا القانون محسوبة
من تاريخ صرف تلك
المبالغ وحتى تاريخ ردها للمؤسسة.
