يعاقب بالأشغال المؤقتة وبغرامة لا تقل عن الفي دينار ولا تزيد على خمسة آلاف دينار كل من
قدم مادة مخدرة او مؤثرا عقليا لشخص آخر لاستهلاكها دون علمه.
