لورثة المؤلف لاي مصنف وحدهم الحق في ممارسة حقوق الاستغلال المالي المنصوص عليها
في هذا القانون لذلك المصنف ، على
انه اذا كان المؤلف قد تعاقد كتابة اثناء حياته مع الغير بشأن استغلال مصنفه ، فيجب تنفيذ هذا
التعاقد و فقا لشروطه
، و اذا اشترك في تأليف المصنف اكثر من مؤلف و توفي احدهم دون ان يترك وارثا فان نصيبه في
المصنف يؤول الى باقي المشتركين
في تأليفه بالتساوي ما لم يوجد اتفاق خطي على غير ذلك.
