Article text
إذا كان الزوج غائباً و كان له مال يمكن تنفيذ حكم النفقة فيه نفذ حكم
النفقة في ماله وإن لم يكن له مال يمكن تنفيذ حكم النفقة فيه وطلبت
الزوجة التفريق تطبق الأحكام التالية:-
أ- إن كان معلوم محل الاقامة ويمكن وصول الرسائل اليه أعذر القاضي
إليه وضرب له أجلاً فإن لم يرسل ما تنفق منه الزوجة على نفسها أو لم
يحضر للإنفاق عليها طلق عليه القاضي بعد الأجل .
ب- إن كان مجهول محل الاقامة أو لا يسهل وصول الرسائل إليه وأثبتت
المدعية دعواها طلق عليه القاضي بلا إعذار ولا ضرب أجـل .
ج- تسري أحكام هذه المادة على المسجون الذي يعسر بالنفقة.
