التفريق للعجز عن دفع المهر
إذا ثبت قبل الدخول عجز الزوج عن دفـع المهـر المعجل كلـه أو بعضه فللزوجة أن تطلب من
القاضي فسخ الزواج والقاضي يمهـله شهـراً فإذا لم يدفع المهر بعد ذلك يفسخ الزواج بينهما أما
إذا كان الزوج غائباً ولم يعلم له محل إقامة ولا مال له يمكن تحصيل المهر منه فإن العقد يفسخ
دون إمهال.
