أ- اذا أصيب الموظف الخاضع لقانون التقاعد المدني بمرض أو حادث ناشئ عن طبيعة عمله
أثناء قيامه بواجباته الوظيفية دون إهمال منه بناء على تقرير من اللجنة الطبية المختصة فيمنح
( خلال المدة المحددة في المادتين 57 ) ( و 58 ) من هذا النظام وبقرار من الوزير راتبه كاملا.
ب- إذا أصيب الموظف الخاضع لقانون الضمان الاجتماعي بحادث يدخل في مفهوم إصابة
العمل وفقاً لأحكام قانون الضمان الاجتماعي فتطبق عليه أحكام ذلك القانون.
