ان المدير او الكاتب العدل الذي يتسلم السند يتحقق على مسؤوليته هوية المستدعين
واهليتهم. ويذكر هذا التحقيق في محضر
الضبط او في السند اما فيما يختص بالسندات المنظمة في الخارج فتعتبر هوية المتعاقدين
محققا فيها اذا كانت الامضاءات
الموقعة بذيل السندات المبرزة قد صودق عليها متضمنة الشروحات والاثباتات التي تفرضها
القوانين المرعية الاجراء تحت
طائلة البطلان.
