اذا كان المتعاقدان يجهلان التوقيع او القراءة او يعجزان عنهما فان الاعتراف بمضمون الضبط
يجري امام المدير او الكاتب
العدل بحضور شاهدين يتمتعان بالاهلية المدنية ويحسنان الامضاء.
ويثبت المدير او الكاتب العدل الاعتراف ، بمضمون محضر الضبط او السند ويوقعه مع الشهود.
اذا كان المدير او الكاتب
العدل يجهلان اسماء المتعاقدين او احوالهم الشخصية او محلات اقامتهم فيجب تحققها
بشاهدين يعرفانهما وتتوفر فيهما الشروط
الآنفة الذكر.
وفي كل الحالات يجب على المدير او الكاتب العدل ان يثبت معرفته للشهود بذيل التصريح.
