يمكن دائما فسخ عقد التأمين تبعا لمشيئة المؤمن له ، ما دامت الاخطار لم يبتديء مجراها.
والمؤمن له الذي لا يستطيع اثبات حالة القوة القاهرة يدفع للمؤمن بدل تعويض مقطوع
مقداره نصف القسط المحدد في العقد.
