ان محكمة مكان الحجز تقرر البيع وشروطه كما بينها طالب الحجز وتحدد تاريخه وثمن الطرح.
واذا لم يعرض اي ثمن في اليوم المحدد للبيع فتحدد المحكمة ثمناً للطرح جديداً أقل من الثمن
الاول وتاريخاً للمزايدة
