1 - للمحكمة ان تأمر باتخاذ التدابير الاحتياطية اللازمة لصيانة حقوق الدائنين بناء على طلب
النيابة العامة او من
تلقاء نفسها.
2 - وللمحكمة عند الاقتضاء ان تشهر الافلاس من تلقاء نفسها ايضاً.
