Article 335 of Commercial Law No. 12 of 1966
Article text
1 - ان ابطال الاعمال المتقدم ذكرها يجيز عند الاقتضاء اقامة دعوى الاسترداد.
2 - واذا كان محل الوفاء سند سحب او شيكا فلا يجوز ان تقام الدعوى المذكورة الا على الشخص
الذي اعطي السند او الشيك
لحسابه.
3 - امااذا كان محل الوفاء سندا " لامر " فلا يجوز ان تقام الدعوى الا على المظهر الاول .
4 - وفي كلا الحالين يجب ان يقام الدليل الى ان الشخص الذي يطلب منه الرد كان عالما وقت
اصدار السند بتوقف المدين عن
الدفع.
