Article text
1 - تعاد الى الدائنين السابقين لعقد الصلح جميع حقوقهم تجاه المفلس وحده. اما بالنسبة
الى كتلة الدائنين فلا يمكنهم
الدخول فيها الا ضمن الحدود الآتية:
أ- اذا لم يقبضوا شيئاً من المعدل المئوي عندالتوزيع فيدخلون فيها بكامل دينهم.
ب- اذا استوفوا جزءاَ من ذلك المعدل فيدخلون بجزء من ديونهم الاصلية يناسب الجزء الذي
كانوا موعودين به من المعدل
المئوي ولم يقبضوه.
2 - وتطبق احكام هذه المادة في حالة وقوع افلاس ثاني لم يسبقه ابطال عقد الصلح او فسخه.
