اذا احدث شخص منشآت بمواد من عنده على ارض غيره باذنه فان لم يكن بينهما اتفاق على
مصير ما احدثه فلا
يجوز لصاحب الارض ان يطلب قلع المحدثات. ويجب عليه اذا لم يطلب صاحب المحدثات قلعها،
ان يؤدي اليه قيمتها قائمة.
