اذا احدث شخص غراسا او منشآت اخرى بمواد مملوكة لغيره على ارض احد، فليس لمالك المواد
ان يطلب استردادها
وانما له ان يرجع بالتعويض على المحدث، كما ان له ان يرجع على صاحب الارض بما لا يزيد عما
هو باق في ذمته للمحدث
من قيمة تلك المحدثات.
