لا يجوز لصاحب العقار الخادم ان يأتي بعمل من شأنه التأثير على استعمال الحق المجرد او تغيير
وضعه الا
اذا كان الانتفاع في المكان القديم أصبح أشد ارهاقا لمالك العقار الخادم او كان يمنعه عن
القيام بالاصلاحات المفيدة
، وحينئذ لمالك هذا العقار ان يطلب نقل الحق الى موضع يتمكن فيه من استعمال حقه
بسهولة الموضع القديم.
