Article text
د- محل الوفاء وزمانه ومكانه ونفقاته واثباته:
1 - اذا كان الدين مما يتعين بالتعيين فليس للمدين ان يدفع غيره بدلا عنه دون رضا الدائن حتى لو
كان هذا
البدل مساويا في القيمة للشيءالمستحق او كانت له قيمة أعلى.
2 - اما اذا كان مما لا يتعين بالتعيين وعين في العقد فللمدين دفع مثله وان لم يرض الدائن.
