1 . - ليس للمدين ان يجبر الدائن على قبول وفاء جزئي لحقه ما لم يوجد اتفاق او نص يجيز ذلك
2 - فاذا كان الدين متنازعا في جزء منه وقبل الدائن ان يستوفي الجزء المعترف به فليس للمدين
. ان يرفض الوفاء بهذا الجزء
