اذا تعددت الديون في ذمة المدين وكانت لدائن واحد ومن جنس واحد وكان ما اداه المدين لا
يفي بهذه الديون
جميعا جاز للمدين عند الوفاء ان يعين الدين الذي يريد الوفاء به ما لم يوجد مانع قانوني او
اتفاقي يحول دون هذا التعيين.
