1 - لا يصح اشتراط عدم ضمان البائع للثمن عند استحقاق المبيع ويفسد البيع بهذا الشرط.
2 . - ولا يمنع علم المشتري بان المبيع ليس ملكا للبائع من رجوعه بالثمن عند الاستحقاق
