1 - يلتزم المقترض برد مثل ما قبض مقدارا ونوعا وصفة عند انتهاء مدة القرض ولا عبرة لما يطرأ
على قيمته من
تغيير وذلك في الزمان والمكان المتفق عليهما.
2 - فاذا تعذر رد مثل العين المقترضة انتقل حق المقرض الى قيمتها يوم قبضها.
