Article text
1 - ينفسخ عقد المقاولة بموت المقاول اذا كان متفقا على ان يعمل بنفسه او كانت مؤهلاته
الشخصية محل الاعتبار
في التعاقد.
2 - واذا خلا العقد من مثل هذا الشرط او لم تكن شخصية المقاول محل اعتبار جاز لصاحب العمل
ان يطلب فسخ العقد اذا لم
تتوافر في الورثة الضمانات الكافية لحسن تنفيذ العمل.
3 - وفي كلا الحالين يستحق الورثة قيمة ما تم من الاعمال والنفقات وفقا لشروط العقد وما
