1 - لا ينسب الى ساكت قول ولكن السكوت في معرض الحاجة بيان ويعتبر قبولا.
2 - ويعتبر السكوت قبولا بوجه خاص اذا كان هناك تعامل سابق بين المتعاقدين واتصل الايجاب
. بهذا التعامل او اذا تمخض الايجاب لمنفعة من وجه اليه
