اذا نقض الحكم بسبب
1 ) وقوع خطأ في أصول المحاكمة يعتبر النقض شاملا لذلك القسم من الاجراءات التي وقعت
. بعد السبب الذي أوجب النقض
2 ) كونه مغايرا للقانون يترتب على المحكمة التي أعيد اليها أن تدعوا الفريقين وتصحح حكمها
. بمواجهتهما
3 ) نقص الحكم الأخير من الحكمين المتناقضين فلا يبقى لزوم لرؤية الدعوى الثانية ولكن اذا
نقض الحكمان كلاهما يجب اعادة
الدعوى الى المحكمة التي من اختصاصها النظر فيها لتراها وتفصل فيها من جديد.
