لا يجوز أن يتمسك بالبطلان الا من شرع البطلان لمصلحته. ولا يجوز التمسك بالبطلان من الخصم
الذي تسبب فيه وذلك كله فيما عدا الحالات التي يتعلق فيها البطلان بالنظام العام. ويزول
البطلان إذا نزل عنه صراحة أو ضمنا من شرع لمصلحته وذلك فيما عدا الحالات التي يتعلق فيها
بالنظام العام.
