Article text
أ الاستئناف من حق النيابة العامة والمدعي -
. والمحكوم عليه والمسؤول بالمال
ب- تُستأنف الأحكام الصادرة عن محاكم الصلح في
القضايا الجزائية إلى محكمة البداية بصفتها الاستئنافية
خلال مدة عشرة أيام من اليوم التالي لصدور الحكم إذا
كان وجاهياً.
ج- تفصل محكمة البداية بصفتها الاستئنافية بالطعون
المقدمة إليها تدقيقاً ما لم تقرر من تلقاء نفسها أو
بموافقتها بناءً على طلب أحد الأطراف نظرها مرافعةً.
د- تُحفظ أوراق الدعوى في قلم محكمة الصلح إلا إذا
استأنف أحد الأطراف الحكم المنهي للخصومة فترسلها
المحكمة إلى قلم المحكمة المستأنف إليها بعد أن تبلغ
صورة عن لائحة الاستئناف إلى الفريق الثاني، وله أن يقدم
لائحة بدفاعه خلال عشرة أيام من اليوم التالي لتاريخ
تبليغه لائحة الاستئناف.
