Electronic Means in Civil Judicial Proceedings Regulation No. 95 of 2018
Article text
أ- تعتمد الوسائل الإلكترونية التالية لإجراء التبليغات
القضائية:-
1 - البريد الإلكتروني .
2 . - الرسائل النصية عن طريق الهاتف الخلوي
3 . - الحساب الإلكتروني المنشأ للمحامي
4 . - أي وسيلة أخرى يعتمدها الوزير
ب- عند إجراء التبليغات بالوسائل الإلكترونية تراعى
الشروط والبيانات التي يجب توافرها في التبليغات
القضائية المنصوص عليها في القانون.
ج- لكل صاحب مصلحة حق الطعن بعدم صحة التبليغ
الجاري بالوسائل الإلكترونية خلافاً لأحكام هذا النظام.
د- يكون للتبليغ الذي يتم وفقاً لأحكام هذا النظام الآثار
القانونية ذاتها التي تكون للتبليغات التي تتم وفقاً
لأحكام القانون.
هـ- تتخذ الوزارة كل ما يلزم من إجراءات تمكن المحاكم
من أرشفة التبليغات التي تتم بالوسائل الإلكترونية
للرجوع إليها عند الحاجة.
