Article text
أ- للشريك في عقار مملوك على الشيوع أن يطلب
قسمته ولا يحق لأي من شركائه فيه أن يرفض هذا الطلب .
ب- يجوز تأخير قسمة العقار المملوك على الشيوع لمدة لا
( تزيد على 5 ) خمس سنوات باتفاق جميع الشركاء فيها.
ج- لا يحول اتفاق الشركاء على استمرار الشيوع لمدة غير
محددة دون مباشرة أي منهم حقه في طلب إجراء
القسمة.
د- ليس للشركاء في ملكية عقار أن يطلبوا إزالة الشيوع
فيه، سواء أكان بالتصرف فيه أم بقسمته، إذا تبين من
الغرض الذي خصص له وجوب بقائه مملوكاً على
الشيوع.
