Article text
يجري التصرف في العقار المملوك على الشيوع وفق
احكام المادتين ( 96 ) و ( 97 ) من هذا القانون سواء أكان
بين الشركاء ناقص أهلية أم فاقدها أم غائب أم مفقود،
على أن يمثل أيا من هؤلاء الولي أو الوصي أو القيم الذي
ينوب عنه قانوناً، سواء في طلب التصرف في العقار أو
في الاعتراض عليه بعد الحصول على إذن بذلك من
المحكمة الدينية المختصة.
