Article text
أ- إذا كان على العقار المطلوب قسمته بناء واتفق مالكو ( ثلاثة أرباع حصص العقار على 3⁄4 )
( قسمته فتجري قسمته وفقاً لأحكام المادة 106 ) من هذا القانون.
ب- تطبق أحكام الأبنية والتجمعات العقارية الواردة في هذا القانون على قسمة الأراضي
المقامة عليها طوابق وشقق.
ج- يفرز الجزء غير المبني الذي يقبل القسمة عن الجزء القابل للقسمة المقام عليه بناء، من
العقار الذي تجري قسمته، في حال أبدى مالكو ( 3⁄4 ) ثلاثة أرباع حصص العقار رغبتهم في ذلك.
