Article text
أ- يلزم الشركاء بدفع نفقات إزالة الشيوع كل بنسبة حصته حسب القيمة التي قدرت للعقار
وقت إزالة الشيوع.
ب- ينفذ قرار لجنة إزالة الشيوع في العقار ببيع العقار بالمزاد العلني لدى دائرة تنفيذ المحكمة
التي يقع العقار ضمن اختصاصها.
ج- ينفذ القرار الصادر في طلب إزالة الشيوع في السجل العقاري لدى مديرية التسجيل دون
وساطة دائرة التنفيذ.
د- تقرّر اللجنة الحجز على العقار والأثمان والفروقات النقدية ونفقات إزالة الشيوع لغايات تنفيذ
قراراتها.
هـ- ينفذ القرار الصادر عن لجنة إزالة الشيوع في العقار بالمصاريف والنفقات والفروقات النقدية
لدى دائرة تنفيذ المحكمة.
