Article text
أ- على المستملك ان يتقدم إلى المجلس بطلب إصدار
قرار باستملاك العقار خلال ( 90 ) تسعين يوماً من تاريخ
انتهاء المدة الواردة في إعلان الاستملاك ، على أن يرفق
بطلبه خريطة للعقار المطلوب استملاكه، وتقرير كشف
يتضمن وصفاً للعقار وتقديراً أولياً لمقدار التعويض عن
الاستملاك على ان لا يقل عن القيمة المعتمدة استناداً
لقانون رسوم تسجيل الأراضي ، وما يثبت مقدرته على
دفعه لمستحقيه .
ب- إذا انقضت المدة الواردة في الفقرة (أ) من هذه المادة
دون التقدم بالطلب، فيعد إعلان الاستملاك كأن لم يكن.
