Article text
أ للمجلس، إذا ثبت له أن تنفيذ المشروع يحقق نفعاً عاماً -
وأن لدى المستملك القدرة على دفع مبلغ التعويض، أن
يقرر حسب مقتضى الحال، استملاك العقار أو استملاك
حق عيني عقاري لمدة محددة أو فرض حق ارتفاق أو قيد
على ممارسة حق متفرع عن حق ملكية العقار، على أن
يصدر المجلس قرار الاستملاك خلال ( 180 ) مائة وثمانين يوماً
. من تاريخ انتهاء المدة الواردة في إعلان الاستملاك
معاملة عليه، باستثناء معاملات الانتقال
ب- ينشر قرار المجلس في الجريدة الرسمية ويعتبر نشره
بينة قاطعة على ان المشروع الذي يراد استملاك العقار
من اجله مشروع للنفع العام.
ج- إذا انقضت المدة الواردة في الفقرة (أ) من هذه المادة
دون صدور قرار الاستملاك ف يعتبر إعلان الاستملاك كأن لم
يكن.
