1 - لا يجوز لقاض ان يحكم بالدعوى التي تولى وظيفة النيابة العامة فيها.
2 - وانما يجوز لقاضي صلح النظر في دعوى قام بالتحقيق فيها كمدعي عام، بشرط ان لا يكون
