اذا حكم على شخص بالوجه الغيابي وسقطت بالتقادم العقوبة المحكوم بها عليه فلا يسوغ
له في مطلق الاحوال
أن يطلب من المحكمة ابطال محاكمته الغيابية ورؤية الدعوى بحقه مجددا.
