Article text
أ- ترفع المحاكم الابتدائية الشرعية إلى محكمة الاستئناف الشرعية الأحكام المبينة أدناه بعد
مضي ثلاثين يوماً من صدور الحكم لنظرها تدقيقاً:-
1 - الأحكام الصادرة على القاصرين وفاقدي الأهلية وعلى الوقف وأحكام النسب والحجر والدية .
2 - أحكام فساد الزواج وبطلانه وإثبات الزواج وإثبات الطلاق وإبطاله والرضاع المانع للزوجية
والإمهال للعنة والجنون والتفريق بين الزوجين للردة وإباء الإسلام والإيلاء والظهار والفقد وإثبات
الرجعة وإبطالها وإثبات الفقد والغياب والحكم بموت المفقود .
3 - الأحكام الغيابية بالتفريق بين الزوجين لأي سبب من أسباب التفريق.
ب- يشترط في الأحكام المنصوص عليها في الفقرة (أ) من هذه المادة ان لا يكون الخصوم قد
استأنفوا هذه الأحكام خلال المدة المحددة وفصلت محكمة الاستئناف في موضوعها .
